1. About KhojKaro

KhojKaro.in (“Platform”) is an intermediary platform that connects job seekers with employers, room/PG seekers with landlords, and service seekers with providers in Siliguri, Jalpaiguri, and North Bengal. We are a facilitator, not an employer, landlord, or service provider.

2. Eligibility

• You must be at least 18 years old
• You must provide accurate, complete information
• You must have legal authority to enter binding agreements
• Businesses must hold valid registrations (GST/Udyam/Trade License) where applicable

4. User Obligations

4.1 All Users Must:

• Provide truthful, accurate, and complete information
• Not impersonate any person or entity
• Not use our services for any illegal, fraudulent, or harmful purpose
• Not harass, abuse, or threaten our staff or other users
• Not attempt to reverse-engineer, scrape, or copy our platform, content, or data
• Not use automated tools (bots, scrapers) without written permission
• Comply with all applicable Indian laws

4.2 Business Clients Must Additionally:

• Provide legitimate, legal listings only
• Not post discriminatory listings (caste, religion, race — except genuine occupational requirements)
• Not use Lead Data for any purpose other than the specific match
• Not resell, share, or transfer Lead Data to any third party
• Not contact users for unsolicited marketing unrelated to the original match
• Pay all agreed fees and commissions within stipulated timelines
• Maintain own legal compliance (labor laws, tenancy laws, DPDPA)
• Not require users to pay any fee to KhojKaro as condition of hiring/renting

5. Intellectual Property

• All content on KhojKaro.in (text, design, code, logos, data compilations, SEO pages) is our exclusive property protected under the Copyright Act, 1957
• No reproduction, distribution, modification, or derivative works without written permission
• Scraping, crawling, or automated extraction is prohibited and actionable under Section 43 of the IT Act, 2000 (compensation up to ₹1 Crore)
• Business Client listings remain their property; we hold an irrevocable, royalty-free license to display them

6. Verification & Trust

• Verification is NOT a guarantee of legitimacy, quality, or safety
• Users must exercise own due diligence
• Visit premises before paying deposits; verify employer identity independently
• Never pay advance fees to anyone claiming to represent KhojKaro

7. Fees & Payments (B2B)

• Service to individual users (B2C) is completely free
• Business Clients pay as per separately agreed terms
• All fees exclusive of GST (18%) unless stated
• Late payments attract 2% per month interest
• Fee structure may change with 15 days notice
• No refunds on delivered leads unless data is demonstrably incorrect

9. Indemnification

You agree to indemnify, defend, and hold harmless KhojKaro, its founder(s), employees, agents, and partners from all claims, liabilities, damages, losses, costs, and expenses (including attorney fees) arising from:

• Your use or misuse of our services
• Your violation of these Terms or any applicable law
• Your violation of any third party’s rights
• Content or information you provide to us
• Disputes between you and a Business Client/User introduced through us
• Claims by Users against Business Clients for post-introduction actions

10. Termination

• We may suspend or terminate access at any time, for any reason, with or without notice
• Immediate termination for: fraud, abuse, harassment, Terms violation, non-payment, illegal activity, or platform harm
• Upon termination: right to use ceases; we retain data per Privacy Policy; outstanding fees remain payable
• Sections 5, 8, 9, 11, 12, and 13 survive termination

11. Dispute Resolution

1. Informal Resolution: Contact hello@khojkaro.in. We attempt resolution within 15 days.
2. Mediation: If informal fails, mediation before mutually agreed mediator in Siliguri.
3. Jurisdiction: If mediation fails within 30 days, exclusive jurisdiction of civil courts in Siliguri, West Bengal, India.
4. No Class Actions: All disputes must be brought individually. You waive any right to class actions or representative proceedings.

12. Force Majeure

Not liable for failure/delay due to causes beyond reasonable control: natural disasters, pandemics, government actions, internet outages, infrastructure failures, civil unrest, or any force majeure event.

13. General Provisions

• Entire Agreement: These Terms + Privacy Policy = complete agreement
• Severability: Invalid provision doesn’t affect remainder
• No Waiver: Non-enforcement doesn’t waive the right
• Assignment: We may assign; you may not
• Amendments: 7 days notice for material changes; continued use = acceptance
• Language: English version prevails in conflict with translations
• Notices: To us: hello@khojkaro.in. To you: registered WhatsApp/email.

14. Anti-Scraping & Competitor Clause

• Use by competitors for market intelligence, lead poaching, or content copying is strictly prohibited
• Unauthorized automated access constitutes offence under Section 43 IT Act, 2000 — punishable with compensation up to ₹1 Crore
• We actively monitor and will pursue legal action without warning

15. Governing Law

Governed by laws of India including: Information Technology Act 2000, Indian Contract Act 1872, Consumer Protection Act 2019, Copyright Act 1957, and Digital Personal Data Protection Act 2023.
